Bishop Gafaranga’s Trial: Confidential Court Hearing Amid Sexual Violence Allegations
On Thursday, May 22, 2025, the closed-door court proceedings regarding Bishop Gafaranga’s provisional detention commenced. Gafaranga, a public figure known in the media and music industry, faces serious allegations of sexual violence.
All attendees were instructed to exit the courtroom to ensure privacy during the hearing. This decision was made following a request from the victim, prioritizing their right to confidentiality and security.
Bishop Gafaranga was arrested on May 7, 2025, and has since been detained at the RIB station in Nyamata, Bugesera District, as the investigation into the accusations continues.
Key decisions concerning his provisional detention remain pending, with uncertainty over whether he will remain in custody or be granted provisional release.
Court sessions can be requested to be held in confidentiality (huis clos/confidentialité) by either the defendant or the victim. Such measures are designed to protect the dignity, safety, and rights of the individuals involved.
Confidential hearings serve to shield victims, especially in cases involving sexual violence, infidelity, or abuse against children, from further harm or damage to their reputation.
Disclosures during court proceedings could embarrass or distress the victim. To mitigate potential psychological effects or stigmatization, courts opt for private hearings when necessary.
In situations where witnesses may face intimidation or danger due to their testimonies, courts also choose to close the hearings to the public.
For unresolved cases, public hearings can harm the accused’s reputation, particularly when evidence is inconclusive or indicates potential acquittal. This privacy measure ensures the accused is not unjustly defamed before a final judgment.
Certain domestic or international laws mandate confidential proceedings for cases involving minors or victims of extraordinary violence, citing unique legal circumstances.
In Rwanda, these provisions align with laws safeguarding children, victims of gender-based violence, and broader judicial processes. Additionally, the prosecution can request closed hearings when deemed necessary.
As it stands, Bishop Gafaranga’s court trial remains under high confidentiality to protect the involved parties.
